No. Your statement shows totals only, and small numbers read "fewer than 5", so nobody can be picked out. Your members never agreed to their gym being told.
Yes, a short partner agreement. Either of us can end it with 30 days' notice, and you keep earning from members who already joined, unless it ends because of a breach.
