1. Introduction
These Terms of Service ("Terms") govern your access to and use of Physique Pilot (the "Service"), provided by Walsham Group Limited, a company registered in England and Wales (company number 17209232) with its registered office at 192 Maldon Road, Colchester, Essex, CO3 3AZ, trading as Physique Pilot ("Walsham Group", "we", "us", "our").
By creating an account or using the Service, you ("you", "your", "User") agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Definitions
- "Account" means the account you create to access the Service.
- "Content" means any text, images, photos, data, and other materials submitted to the Service by Users.
- "Subscription" means a paid plan giving access to specified features of the Service.
- "Free Trial" means the period at the start of a Subscription during which you are not charged.
- "Partner" means a gym, university, society, creator or other organisation or person that gives its members or followers a link to join the Service.
3. Eligibility
You must be at least 18 years old to use the Service. By creating an Account, you confirm that you are 18 or over and have the legal capacity to enter into these Terms. The Service is not directed at and must not be used by minors.
4. Account registration
You agree to:
- Provide accurate, current, and complete information when creating your Account
- Keep your login credentials confidential and not share them with others
- Notify us immediately of any unauthorised access to your Account
- Be responsible for all activity that occurs under your Account
We may refuse, suspend, or terminate Accounts that violate these Terms or are otherwise misused.
5. Subscriptions, fees and renewals
The Service requires a Subscription. The price and billing period are shown before you subscribe, and the price shown at that point is the price you pay. Our current prices are:
- On our website: £7.99 every 4 weeks, or £72 a year
- In the iPhone and Android apps: £9.99 a month, or £84.99 a year
- Free Trial. A new Subscription starts with a 14-day Free Trial, or 28 days if you join through a Partner’s link and subscribe on our website. The length that applies to you is shown before you start. On our website you give your card details when the Free Trial starts. You are not charged during the Free Trial. If you do not cancel before it ends, your Subscription continues and the first payment is taken at the end of the Free Trial
- One Free Trial per email address. If an email address has had a Free Trial before, a new Subscription with it starts without one and the first payment is taken straight away
- We email you a confirmation when your Subscription starts, setting out your plan, price and how to cancel
- Subscriptions automatically renew at the end of each billing period at the then-current price, unless cancelled before renewal. If you are on a yearly plan, we email you before it renews
- We may change Subscription prices on at least 30 days’ written notice; price changes take effect at the next renewal, and you can cancel before then
- We are not registered for VAT, so no VAT is added to the prices on our website. App Store and Google Play prices are set and collected by Apple or Google and include any VAT they charge
- Who takes the payment depends on where you subscribe. On our website, payments are processed by Stripe and you are also subject to Stripe's terms of service. Inside the iPhone or Android app, the purchase is made through Apple or Google respectively, and their terms apply to it
Partner and gym referrals
Where you join through a gym or other partner link, your account is recorded as having come from that partner and you may be offered a longer free trial than our standard one. The trial length applicable to you is shown before you subscribe, and it is the length shown at that point that applies.
Some Partners, such as gyms and creators, earn a share of what you pay us for a period after you join. This does not change your price. A partner referral changes nothing else about your Subscription, and it gives the Partner no access to your account or your data. Partners receive totals only; they are never told which of their members hold an account or a Subscription.
Refer a friend
Members on a paid Subscription can share a personal link. If you create your account through a member’s link and subscribe on our website, you get a 28-day Free Trial instead of our standard 14 days. If you subscribe in the iPhone or Android app, the standard trial applies, because Apple and Google set their own trial lengths. The member who shares the link gets nothing in return.
The offer is for people who have not had a Free Trial with that email address before. It does not combine with a Partner’s offer: if you join through both, you get the longer of the two trials, not both, and the Partner’s link counts. A link only works while its member has a paid Subscription. The trial shown before you subscribe is the one you get.
We may change or end this offer at any time, and we may turn off a link that is misused, for example one posted on a discount or voucher site, or used to create accounts that are not real people. Anyone who has already started their trial keeps it.
6. Refunds and cancellation
You may cancel your Subscription at any time, and where you do it depends on who took the payment. If you subscribed on our website, cancel from the Settings page. If you subscribed inside the iPhone app, cancel in your Apple Account settings under Subscriptions. If you subscribed inside the Android app, cancel in Google Play under Subscriptions. The Settings page links you to the right place. Cancellation will take effect at the end of the current billing period. You retain access until that period ends, and you will not be charged again.
Your right to cancel. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you may cancel a new Subscription within 14 days of the day it starts, without giving a reason. Your Subscription starts when your Free Trial starts, so those 14 days fall inside the Free Trial and cancelling during them costs you nothing. To cancel, use Settings or the App Store or Google Play as described above, or email us.
If you have had a Free Trial before, your Subscription starts without one and the first payment is taken straight away. You can still cancel within 14 days, and the refund of your first payment below applies.
Refund within 14 days of your first payment. If you ask within 14 days of your first payment (the one taken when your Free Trial ends, or when you subscribe if you have no Free Trial), we will refund that payment in full and end your Subscription. This is in addition to, and does not reduce, your statutory rights.
- Subscribed on our website: email coach@physiquepilot.com and we refund through Stripe.
- Subscribed in the Android app: email us and we refund through Google Play.
- Subscribed in the iPhone app: Apple handles all App Store refunds, and we cannot issue them. Request one from Apple at reportaproblem.apple.com.
After those 14 days, payments are not refundable, including for part of a billing period, except where the law requires a refund (for example if the Service is faulty). You keep access until the end of the period you have paid for. We may offer a refund in exceptional circumstances.
7. Acceptable use

Your acknowledgement. Before an AI feature generates something for you, we ask you to acknowledge that your data will be shared with our AI provider, OpenAI. 11. Intellectual property
The Service, including all software, design, branding, text, graphics, and other content (excluding User Content), is owned by Walsham Group Limited or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes in accordance with these Terms.
You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.
12. Wearable integrations
Where you choose to connect a third-party wearable or health service (such as Oura, Whoop, or Apple HealthKit), you authorise us to receive data from that service in accordance with your authorisations on that service. You may disconnect any integration at any time from the Settings page. We are not responsible for the accuracy, availability, or behaviour of any third-party service.
13. Third-party services
The Service relies on third-party providers (including those listed in our Privacy Policy). We are not responsible for the acts, omissions, or content of any third-party service, and your use of any third-party service is subject to that provider's own terms and privacy policy.
Food composition data. Nutrition values for generic foods are derived from McCance & Widdowson’s The Composition of Foods integrated dataset (CoFID), © Crown copyright, used under the Open Government Licence v3.0, and from the U.S. Department of Agriculture’s FoodData Central, which is in the public domain. Neither source endorses this Service. Values are typical figures for a food and will differ from any specific product you eat.
14. If you use the iPhone app
If you download the Physique Pilot app from Apple’s App Store, these Terms are also its end user licence agreement, and the following applies as well:
- These Terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content
- Your licence to use the app is limited to using it on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions (which also allow Family Sharing where applicable)
- We, not Apple, are solely responsible for maintenance and support of the app. Apple has no obligation to provide any
- If the app fails to conform to any warranty that applies to it, you may notify Apple and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, costs or expenses caused by a failure to conform to a warranty are our responsibility
- We, not Apple, are responsible for addressing any claims by you or anyone else relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws, including in connection with Apple Health (HealthKit)
- If anyone claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim
- You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties
- You must comply with any third-party terms that apply when you use the app, such as your mobile data agreement
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple may enforce them against you as a third-party beneficiary
Questions, complaints or claims about the app go to us, using the details in Section 20.
15. Our responsibility to you
Your statutory rights are not affected. Nothing in these Terms affects your rights as a consumer, including your rights under the Consumer Rights Act 2015 that the Service is as described, fit for purpose, of satisfactory quality, and provided with reasonable care and skill.
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be limited or excluded by law
Subject to the above:
- We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable
- The Service is for your personal, non-commercial use. We are not responsible for any loss of profit, loss of business, business interruption or loss of business opportunity
- We work to keep the Service available and working, but we cannot promise it will always be uninterrupted or free of errors
- Our total liability to you for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (i) the total amount you have paid us in the 12 months before the claim, or (ii) £50
16. Termination
You may terminate your Account at any time from the Settings page or by contacting us.
Inactive accounts. If you have not signed in for 2 years and have no active Subscription, we will email you, and delete your Account and its data 30 days later unless you sign in before then.
Deleting your Account cancels a Subscription you took out on our website. It cannot cancel one taken out through the App Store or Google Play: cancel those with Apple or Google, or they will keep charging you. The app tells you which applies before you delete.
We may suspend or terminate your Account, with or without notice, if:
- You breach these Terms
- We are required to do so by law
- We discontinue the Service (in which case we will provide reasonable advance notice and, where applicable, a pro-rata refund of any prepaid Subscription)
On termination, your right to use the Service ends, but Sections 8 (User Content), 9 (Health Disclaimer), 11 (Intellectual Property), 15 (Our responsibility to you) and 18 (Governing Law) survive.
17. Changes to these Terms
We may update these Terms from time to time. Where changes are material, we will notify you by email and/or via the app at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you may cancel your Account before they take effect.
18. Governing law and disputes
These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any such dispute, except that consumers resident in another part of the UK may bring proceedings in their local jurisdiction where required by law.
Before commencing any legal proceedings, we encourage you to contact us at coach@physiquepilot.com so that we can attempt to resolve the matter informally.
19. General
- Severability: If any part of these Terms is found to be unenforceable, the remaining parts will continue in full force.
- No waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
- Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights to any successor or affiliate.
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
- No agency: Nothing in these Terms creates any agency, partnership, or joint venture between you and us.
- Third parties: Nobody other than you and us has any right to enforce these Terms, except Apple as set out in Section 14.
